WHERE IS OUR MIND !!!

Dear friends see all the photos carefully in this article and think where is your mistake to choose a master. See what Mahabodhi Meditation Centre of Bodhgaya is doing !!! And now you see what Lord Buddha said —  “ The tree that gives you pleasant shade, To sit or lie at need, you should not tear, Its branches down, a cruel wanton deeds ” — The Jataka, Vol IV, Page 222.  Where is our mind ??

Now tell me what kind of master he must be who is running such monastery in Bodhgaya and also running meditation courses ? Where is compassion for a tree ? What kind of student he produce ? Did the master not come to Mahabodhi Temple for prayer ? Can’t he see what his student deed ?  Now look at one of the NGO  from UK “ sacred earth trust ” who is getting support directly from 17th Karma Pa Ugyen Trinley Dorje. Look at the red tin piece. What kind of teachings Karma Pa ji is giving and what kind of student he / she must be ??  Where is our mind ??

Now see what the Hindus are doing. Look the Hindus hang idols and add

All are same. We walk on grass but none of us ever said sorry to these living organism. All of you have attained many courses of big big master but do they ever spoke about it ???  We pee on grasses but none of us ever say sorry to all these grasses !!! Where is the mindfulness of  big big masters as well as within us ???  We spread water on grass only to get pleasure of a lash green field but not as a living organism that needs water to save a life.  Where is our mind ?       

A bullet is the real hero in life. The fear of death forces a person to trigger on. The opposite party knows that if he does not fire then the other party will fire on him. It is the both sides fear of death works behind for which the result is a bullet hits this side or that side and that is not bravery. But we give medal in the name of bravery !!!   Where is our mind ?        

Keep in mind that you are the trusty of Lords money and the money which you have is not your money. A person goes to a Holy Place for Merit but 99% people don’t know what is actually called merit. The basic of merit is people should not offer to lord what the prophet left from His house that means worldly luxurious things. You can offer fruits to the Lord but not a “ Golden Ring ”. You can only offer the basic needs to a monk, which does not mean a Car or an Air Conditioner or a Mobile phone that is demerit if you give. When you are offering any thing to a monk at that time if any other monk from other religion stand beside you or pass away from that very place then you have to show the same kind of respect towards him too the way you respect to your traditional monk and then it will be consider as a  Merit but in practical life we never seen such act. Generally people don’t take back merit from Holy Place for their ignorance. You have to utilize your brain that who is needy. A beggar or a layman dose not mean that he / she is needy. Never give money to any one for any purpose, giving money creates corruption in the society and encouraging people to be lazy and it is demerit. Where is our mind ?         

As soon as you said that my Master is the Best OR my religion is the best OR my traditional monks are the best then you are the most ignorant person in this world which is a great demerit. Your truth is your truth and that truth is not the truth of almighty. So never try to insist others to believe on your truth otherwise it is a demerit. When you are in the foreign land then respect their culture and dress up yourself as they do and go to a Holy Place according to the local tradition and that will be called merit. Where is our mind ??

The Peoples are always talking about PEACE and for that many campaigns, conferences, seminars and prayers taking place in the world and also it is still continue till today. May be the organizers are Hindu or Buddhist or Islamic or any one. The question is where is peace then ??? All the great Monks from all religion are organizing world peace prayer & conference every year but the ultimate result of peace is = BIG ZERO !!! Does it not mean that all these great monks really don’t have any power ???  The hard truth is those people don’t know how to spend their money they are organizing all these peace prayer, conference….etc. More than 50 years of  formation of  United Nation 300 wars took place in the name of freedom and in the name of peace keeping. Where is our mind ??

In the past Lord Rama and Krishna was involved in the war when they were prophets. His Holiness Hazarat Bab from Bahai community also involved in war. Islamic prophets were also involved in war.  Buddhist countries were also involved in the war. Why they did not take path of peace !!!? Do they all foolish ? Do they don’t know that a war killed innocent people ?  Where is our mind ??

Peace cannot be achieved in outer world. The fundamental law is if there is no destruction then you cannot think of construction. Peace is within you. It is not out side. How to achieve it that must be the question and it must be asked by all of us. And for that you have to think what are the basic needs for a human to live a life and for that you need a place to sit and think. Where is our mind ? 

To achieve peace :-

1st you have to surrender yourself to the will of almighty that means what ever is happening in this world that is the will of almighty and accept it gladly with out asking any question and then you can achieve “Peace”.

2nd you need “Security”, so how to achieve it ?? You work in any field so that you can earn some money and that is security.

3rd you need “Prestige”, so how to achieve it ?? You lived an honest life which will bring you prestige in the society.

4th you need “Knowledge”, so how to achieve it ?? You read the Holy Books and practice the advice in your life. To teach is to learn. That is called knowledge.

5th you need “ Marriage” but what type of girl ?? Choose a girl who believes in simplicity and also believe that the children’s are the property of “ Lord ” not mine.

When human being follows all these points then peace will reach to them and then we can think of world peace. The hard truth is all these points will never followed by everybody and peace will never be achieved in the society. Where is our mind ???

When a monk said this land is mine, this thing is mine, who lives in luxury is not a monk but today’s psycho blindness of devotees rich or poor ruined the monk’s community. Weak up devotees that is my plea.   Where is our mind ?           

WHO DID IT ? WHAT A SHAME FOR 2 LEGS !!!!!

Look at the condition of this mental lady who have no one !! She is pregnant by some anti social element in the land of enlightenment the great Bodhgaya, Bihar, India. Who is going to look after the coming babe ? What will be the condition of that new born babe ? The Medical Termination of Pregnancy ( MTP ) Act 1975 does allow for abortion with condition to a lady but from the out look of Indian culture it is not permitted. Holy Scripture does not allow it too.

I beg to our District Magistrate Of Gaya Smt. Bandana Ji to help this lady but I have a big question within self that I the Arup Bramhachari ( Swami Ji ) filed FIR for her mis-deeds, a Legal Notice and taking her to supreme court soon so how she can listen my words ??? Let us all pray for this lady.

19-05-2012 .. Today i came to know that the lady gave birth of a cute boy yesterday. The bodhgaya health centre one way kick out the lady from hospital in this condition ….. not even they take care of this mad lady for 24 hours. I search a lot and spoke to the authority and lastly found that a nurse from Magadh Medical Collage Madam Sujata Sarkar ( Phone No. 9709445994 ) is taking care of the babe. The babe is having high fever.  I wrote a letter to DM gaya again( dated 19-05-2012 and 20-05-2012 ).

No help from the District Magistrate of gaya even when she is a lady. Where is that lady even i don’t know. No one helps this mad lady. Sorry to say no respect for a mad people in my country. So many news channels we have in India but no one came forward to help this lady and lastly a kind boy from media cameforward and shoot out full episode to get help. let us pray for the lady and child.

Reference :-   Your letter No. 198 / 27.08.2007 and 2329 / 16.10.2007 dated appertaining to complaint case no. 850 / 2007 Arup Bramhachari Vs Jitendra Srivastav & others to investigate and report relating to the matter in issue.

Sub:- Enquiry report of the matter under reference.

Sir, I have personally enquired on 5.11.2007 and probed about the correctness of the complaint under reference and found the truth as follows :-

1.   It is true that the Bodhgaya Temple Management Committee ( B.T.M.C ) is entrusted with the management and control of Bodhgaya Main Temple, Temple land and the properties appertaining thereto under the Bodhgya Temple Act and as such B.T.M.C has absolute control over the same and no one can do any thing the same without knowledge and permission of B.T.M.C

2.   The persons arrayed as accused in the complaint case under reference are the members and authorities of B.T.M.C

3.   The Great Holy Pipal Tree is of immense archaeological, religious, national, international and social importance and among others the same has also been declared as “ World Heritage ” by the “ UNESCO”. Hence, the great Pipal tree is public property.

4.   On enquiry it transpired to me by the witnesses viz. Deepak Malaker and Ajay Paswan that on 10. 07. 2007 the accused no. 3 Bhante BodhiPal, ordered Sri Deepak Malaker, working as employee of B.T.M.C at that time, to cut down some cardinal parts of the great Pipal tree and in obedience of the dictation of his master the said Sri Deepak Malaker cut down the same in presence of the accused no. 4 Sri Bhajju Yadav. After getting cut down some substantial parts of the great Pipal tree, the said accused Bhante Bodhipal ordered the said Sri Deepak Malaker to carry the same to his house i.e B.T.M.C compound area and accordingly Sri Deepak Malaker carried the cut down piece of the great Pipal Tree to the house i.e B.T.M.C compound area of the said accused Bhante BodhiPal.

5.   I have seen the Cut Off portion of the great Pipal Tree personally and it appeared to me that the cuttings are about 2 years old from now. The “ Forest Research Institute ” of Dehradun also conformed about the cutting down the Holy Pipal Tree.

6.   However, the main control over the “Temple’s ” properties and the great Pipal Tree has been of the accused no. 2 to 4 as they have / had direct links with the day to day affairs of the same. The accused no. 1, being merely an Ex – Officio Chairman of B.T.M.C is honoured with only ornamental post to whom no direct liability should be charged.

7.   At the time of enquiry I also found that the great Pipal Tree leaves collected by their special staff at the time of spring and then sold it to the special friends by the culprits through their high voltage technique. Not only that there are lot of monetary scandal done by the accused no. 2 and 3 which must be checked by the special audit and judicial enquiry may be conducted to know  the nefarious activities going on in the Temple area and B.T.M.C.

8.   Hence, in conclusion, I myself find that the accused no.2 Dr. kalicharan Yadav, 3. Bhante BodhiPal, 4. Bhajju Yadav ( P.R.O ) are involved in some nefarious activities like cutting the branches of the great Pipal Tree, not maintaining any log book which is mandatory to touch the great Pipal Tree. There are no accounts for the leaves they take out from the Tree or are collected. Cutting of branches of the great Pipal Tree have been done casually which even a common man would have not been down it. These people exploiting the “ Temple Area ” and the properties of the B.T.M.C to gain their personal advantages which is related to monetary affairs and a high powered team of expert must investigate the personal wealth of accused no. 2 to 4. Therefore the complaint case under reference is true and correct against no. 2 to 4 and hence accordingly apt and suitable legal action should be taken against all of them.

Grievance of the petitioner in the present writ application filed Public Interest Litigation is regarding mismanagement of the fund of Mahabodhi Temple and its mal-administration.

Having heard Mrs. Rina Sinha, for the petitioner, Mr. Sarvdeo Singh, for the Union of India and taking into consideration the facts and circumstances of the case, we are of the opinion that the petitioner shall be well advised to raise his grievance before the State Government.

Needless to state that in case such a grievance is raised the State Government shall consider the same in accordance with law.

However, we make it clear that we have not expressed any opinion in regard to the claim made by the petitioner.

Application stands dismissed with the observation aforesaid.

IMPORTANCE OF BODHI TREE

Abstract

“……. In a world of growing state and gang violence with western militarism ( lead by an egotistical, paranoid and short sighted leader of the USA ) against a ” war on terror ” which can not be won ( and only produces suffering  for millions of innocent non-combatants ), wisdom, compassion and peaceful diplomacy is the only rational and practical way to save future generations of this world.

A young Indian aesthetic started the peaceful inner revolution of the human mind, ( which is a counter  force to militarism and violence ) 2500 years ago when he became enlightened under  a simple  Bodhi Tree. The teaching of the Buddha are very applicable today and the Bodhi Tree is  ” THE  PEACE  SYMBOL ” of out changing world,  for now  and the future. Since Indian civilization is renound for philosophy, religious  and cultural diversity,  and is aloe the largest demarcation nation in Asia, India now has the moral obligation to be the custodian of the tree for all people of the world.

Now in our age of globalisation, the Buddhist philosophy of interdependence and the doctrine of emptiness are even more  visible  and applicable. Understanding this ancient Indian philosophy is not only gaining popularity but is being accepted by the greatest of political, scientific mind of our time. With His Holiness the Dalai Lama, a Nobel Peace  Prize Laurent and refugee who is eternally grateful to India, as a world representative for Indian Buddhist Philosophy and proponent of Mahatma Gandhi’s peaceful  politics and means, India has such a fantastic opportunity to become a strong voice in the world stage of peacemaking . And the symbol for world peace is the Bodhi Tree. Saving the tree is a statement that says peace is not only possible but absolutely necessary in a fast changing and desirous world. Save the symbol of Ancient Indian Philosophy that can help the world find answers on the path to peace. ….. ”

FIRST SCIENTIST REPORT OF HOLY BODHI TREE

Observations on The Bodhivrikhsa ( Ficus Religiosa ) at Bodhgaya

As requested by the District Magistrate, Gaya a team from Forest Research Institute, Dehradun comprising following scientists visited the Bodhgaya Temple on 28th June 2007 :

1.            Dr. N.S.K. Harsh, Tree Pathologist

2.            Dr. Subhash Nautiyal, Tree Physiolgist

3.            Shir Ram Lal, Wood Scientist

Observations

The revered tree Bodhivrikhsa ( Ficus religiousa ), the papal tree was closely examined and inspected by the team and following observations are made.

1.   The tree is growing normally but major growth is towards one side only while on the other side is temple structure. The branches were spreading towards one side away from the temple.

2.   Just at the base of the tree is the seat of enlightenment ( Bajresan ) on one side towards  the temple.

3.   Around the base of the tree the soil was open, upto 3meters in rectangular shape.

4.   There were dead and dying branches present on the tree. Few branches stubs and wounds of previous cuts were also observed.

5.   The main tree is surrounded by a small-cemented wall and metallic grill.

6.   The small cemented wall surrounding the tree has now been pierced by the roots and has cracked.

7.   Some of the new roots and bark at the base were dying. Some of the roots were exposed on the moil surface.

8.   The stem, bark and exposed wounds were painted with Bordeaux ( copper sulphate, lime and water ) paste as told by Dr. A.K. Singh, Scientist from Rajendra Agriculture University, Patna.

9.   The branches were supported by iron pillars used as props.

10.  Two open surfaces were being used for providing irrigation to the tree outside the main structure. At present they appeared to be having excess water.

11.  Mealy bug attack was also observed on one of the twigs. It was told that there is regular attack of mealy bugs on this and other papal trees in the campus

12.  One dead and decaying branch stub was present near the base ( above 1.5 meters approx. ) on the southwest side, which on tapping gave a hollow sound towards the basal end of the branch suggesting progress of heart rot disease  ( hollowness ). Isolation were made from the decaying part of the stub for associated fungi and other micro-organisms.

13.  Test for hollowness was also conducted all around the main stem by tapping for sound echoes, which reveled absence of heart rot in the trunk at present.

14.  The cut portion of the branch, which has given rise to the present controversy, was closely inspected. The cut branch is nearly 20feet above the ground. On examination the cut end revealed following features :-

a.   Radial as well as longitudinal cracks on the cut surface.

b.   Absence of bark up to 3 feet from the top towards the trunk

c.   Bleached of advance decay of white fibrous rot type.

d.   Bordeaux paste was also applied on the cut end earlier as informed by Dr. A.K. Singh.

e.   The coppice shoots have come out from the lower end where bark was present.

15.  Two other trees of pipal, which were nearby to the Bodhivriksha were also examined. Both the tree showing good vigorous healthy growth, even better then Bodhivriksha. It was informed that during May this year there was premature leaf full of new leaves on the Bodhivriksha, which may be due to some acute physiological stresses affecting the tree. The papal tree on the left of the Bodhivriksha has entrapped the broken cemented wall structure made earlier for boundary by the growing roots of the tree. The tree on the right of the Bodhivriksha was seen wrapped with a yellow cloth around its trunk, which when removed showed termite and fungal attack on the bark of the tree.

16.  The metallic props created for the support of the branches were noticed causing injury to the bark and tissue, which can be seen as dropping of latex on the props.

17.  There was lighting arrangement of the Bodhivriksha in the night. The intensity of the light and heat generated to the nearby branches by the lamp shades, reflectors and bulbs installed may be causing damage to the tree.

18.  No other vegetation was noticed growing below the Bodhivriksha tree.

19.  The moisture content was observed on various parts of the tree for examination of the status of stress. The data is being analyzed.

20.  The samples of wood, bark, leaves and soil were collected for laboratory studies

Inferences drawn about Bodhivriksha

It can be suggested that the Bodhivriksha has recently undergone some form of stress, which was being reflected by the some what scanty and light green leaves in the canopy and damaged roots and bark, as compared to the other two pipal trees growing nearby. The possible reasons for the stress could be :

a.   The light green colour of the leaves may be due to their being new flush and as the leaves are tender.

b.   Copper toxicity due to repeated application of Bordeaux paste on the stem and branches as informed.

c.   Excess moisture in the soil causing asphyxiation ( suffocation ) of the roots as observed in the near by – irrigated areas.

d.   Heat injury due to reflection of solar radiation from the temple structure, which is quite close to the tree.

e.   High intensity electric lights causing hindrance to the respiration process in the night.

f.   The soil was devoid of any other vegetation suggesting an unfavorable environment for the growth of plants, may be due to some heavy metal toxicity.

g.   Soil compaction due to trampling under human feet.

h.   It appears that aging of the tree is slowing down the physiological processes.

Inferences drawn about the cut branch under reference

The stump of the branch was carefully and erratically examined visually and it appears that the cut is more than three years old. The basis of this prediction is explained below.

1.   When a cut or wound is made on a live tree, the sap comes out which is rich in carbohydrates; the sap turns brownish due to the exposure to light and oxygen imparting darker colour to the exposed surface.

2.   The exposed wound is colonized by micro-organisms like bacteria and yeasts.

3.   The exposed surface develop callus and new shoots emerge below the cut.

4.   Weathering of the exposed surface takes place over the time giving bleached appearance to the exposed surface.

5.   Decay fungi set in causing rotting of wood on the dead surface, which may extend to the heartwood establishing heart rot, which gradually create hollowness. The fruiting bodies of the decay fungi then appear on the exposed surface.

6.   The whole processes may take time well over one year but in drier localities with higher temperature this period may be even more than that.

7.   The branch under reference exhibited bleached appearance and decay suggesting it was exposed ( cut ) more than three years ago.

8.   The absence of callus formation, debarking, absence of fruiting bodies of fungi and presence of radial and longitudinal cracks can be attribute to the heat generated by an electric lamp ( top being metallic ) present just below the cut branch which was lighted in the nights. The heat generated gradually causing seasoning ( drying ) of wood revealed as radial and longitudinal cracks on the exposed surface and splitting and falling of bark. The lamp post was moved after March 2006. Moreover, the treatment with Bordeaux paste had also attributed to the debarking, absence of callus and fungal fruiting bodies.

9.   These observations were also corroborated by the photographs provided by the committee, showing date as November 2004 and March 2006 in banners present in the photographs. The cut branch is visible well above the lamppost in these photographs thus confirming the inferences drawn by our study.

10.   The Institute does not have any methodology to precisely determine and predict the time and period of cutting of a tree or its branch, therefore, the predictions made in the present study are suggestive. 

Immediate Steps to be taken for restoration of health for the Bodhivirksha

The declining health of the Bodhivriksha can be restore by adopting following measure :-

1.   The application of Bordeaux paste should be immediately stopped

2.   Excess water in the areas meant for irrigating the tree should be regulated.

3.   The cemented wall near the base should be removed. Care should be taken not to damage the roots underneath it.

4.   The exposed roots should be covered with soil.

5.   Dead branches to be pruned carefully. Small branches may be flush cut initially, but the weight of the branch should be supported until it is completely severed to avoid tearing of the bark below the wound.

6.   The exposed wounds and cut ends should be given dressing with 1 % Bayleton ( Tridemefon ) in linseed oil with a paintbrush to cheek the infection and spread by decay fungi.

7.   Any operation being done for the care and maintenance of the tree should be displayed at a proper place to inform people and for transparency to avoid any controversy.

8.   Between the props and branches thick packing of polyurethane foam should be inserted for cushioning and avoid injury the bark and tissues.

9.   For the management of infestation by mealy bug, spray with 0.02 % Dimethoate should be done on the affected branches with few drops of liquid soap ( shampoo ) as sticker. As the females of the insect crawl from ground on the stern, sticky bands about one meter above ground would cheek their climbing up.

10.  The people should be stopped from going near the tree to avoid soil compaction by trampling.

11.  The metal halide lamps and other lights, which are closed to the tree should be removed. If light of the tree is necessary, it should be done from a distance with low intensity bulbs, preferably focusing from ground fixtures.

12.  The entrapped cement wall piece by the roots of other pipal tree should be carefully removed without damaging the roots.

13.  Wrapping of trees with cloths should be avoided.

14.  Burning of oil lamps and incense sticks should not be allowed to avoid injury to the roots and stem of the trees.

15.  The wooden support and frame around one of the bells ( 2550 kg ) has started showing weathering and decay and needs preservative treatment to be provided by FRI, Dehradun.

Future Course of Action

A memorandum of understanding would be drawn out between the Bodhgaya Temple Management Committee, Bodhgaya and Forest Research Institute, Dehradun for future management and upkeep of the Bodhivriksha in particular and other trees in the campus in general, besides beautification of the campus with suitable plant species. A suitable consultancy project would be developed by Forest Research Institute, Dehradun for this purpose.

SCANDAL GNAWS AT BUDDHA’S HOLY TREE IN INDIA

Its central stupa rising 187 feet above the ground where Siddhartha Gautama is said to have become the “Awakened One,” the temple is thought to have been built 1,500 years ago and was declared a UNESCO World Heritage Site in 2002. Inside, in front of a giant golden statue of Buddha, pilgrims from Japan, Sri Lanka, China, Thailand and the West kneel and chant. Outside, others collect fallen leaves from the giant tree and others growing in the temple courtyard.

Clad in white robes, the barefoot and bearded Brahmachari excitedly points out the spot where the branch was chopped off, as well as empty niches around the temple grounds where he says statuettes of Buddha stood until recently.

“They sent the branch to Thailand, and sold it for 6 crore (60 million) rupees ($1.5 million),” he said, adding he had been beaten up twice and had received several death threats since starting his campaign.

The government, he said, was simply not interested. “Nobody is listening. I am fed up of writing letters.” But he is not alone in his anger, joined by Buddhist priests running many of the other temples and monasteries which have sprung up in Bodh Gaya.

Although its accounts are audited, the priests complain the temple does nothing to support local schools and hospitals, despite having a substantial income. “Money is coming in, but where the money is going nobody knows,” said Bhante Pragyadeep, treasurer of the Buddhist Monks Association of India.

District magistrate Jitendra Srivastava has been running the temple committee since the scandal surfaced and the last committee’s term expired. “All secretaries have been embroiled in controversy,” he said. “It is very unfortunate.” Significant amounts of money had been spent “beautifying the temple and giving it world-class facilities,” he said, and no allegations of corruption had surfaced since he took over.

While the charge of cutting a branch was now sub judice, allegations of deeper wrongdoing had not been substantiated. “A lot of people say this but I have no credible evidence. Read the BTMC act ( Rules No.10 sub rules No. (2) to prevent the discretion of the temple or any part thereof or of any image therein  and Rule No. 13. THE BODHGAYA TEMPLE ACT, 1949

(THE BODHGAYA TEMPLE ACT, 1949 17 OF 1949)

(as modified up to the 8th February, 1955)

[Governor’s assent published in the Bihar Gazette of the 6th July, 1949].

An Act to make provision for the better management of the Bodh Gaya Temple and the properties appertaining thereto.

Whereas it is expedient to make provision for the better management of theBodhGayaTempleand properties appertaining thereto.

It is hereby enacted as follows :-

Short little and Commencement

1. (I) This Act may be called the BodhGaya Temple Act, 1949.

(II) It shall come into force at once.

Definition

2. In this Act, unless there is any thing repugnant in the subject or context-

(a) “the temple” means the great temple built by the site of the Mahabodhi Tree near thevillageofBodh Gayain the district of Gaya and includes the Mahabodhi Tree and Vajrasan ;

(b) “the temple land” means the land in which the temple and its precincts stand and shall cover such area or shall lie within such boundaries as the [2] [State] Government may, by notification direct;

(c) “the Mahanth” means the presiding priest for the time being of Saivite Monastery at Bodh Gaya; and

(d) “Committee” means the committee constituted under Section 3.

3. (1) As soon as may be after the commencement of this the1 [State] Government shall constitute a committee as hereinafter provided and entrust it with the management and control of the temple land and the properties appeartaining thereto.

(2) The Committee shall consist of a Chairman and eight members nominated by the [1] [State] Government, all of whom shall be Indians and of whom four shall be Buddhists and four shall be Hindus including the Mahanth:

Provided that if the Mahanth is a minor or of unsound mind or refuses to serve on the committee, another Hindu member shall be nominated in his place.

(3) The District Magistrate of Gaya shall be the ex-officio Chairman of the Committee: Provided that the1 [State] Government shall nominate a Hindu as Chairman of the Committee for the period during which the district Magistrate of Gaya is non-Hindu.

(4) The [1] [State] Government shall nominate a person from among the members to act as Secretary of the Committee.

4. The Committee shall be a body corporate by the name of the Bodh Gaya Temple Management Committee, having perpetual succession and a common seal, with power to acquire and hold property, both movable and immovable, and to contract, and shall by the said name sue or be sued.

5. (1) The term of office of the members of the committee shall be three years :

Provided that the1 [State] Government, if they are satisfied that the Committee is guilty of gross mismanagement, dissolve the Committee and constitute another Committee or assume direct control of the temple, temple land and the properties appertaining thereto.

(2) Where a member of the Committee dies, resigns, refuses to serve on the Committee, absents himself from six consecutive meetings of the Committee, without the leave of the Committee or ceases to reside in India, or becomes in capable of working, the [1] [State] Government may nominate a person to fill the vacancy.

(3) Any Act done by the Committee shall not be questioned on the ground merely of the existence of any vacancy in or any defect in the constitution of the Committee.

6. The name of the Chairman other than the District Magistrate of Gaya and of every member of the committee shall be published by the1 [State] Government in the Official Gazzette,

7. (1) The Committee shall maintain its office at Bodh Gaya.

(2) At the meeting of the Committee the Chairman, or in his absence one of the members to be elected at the meeting, shall preside.

(3) No business shall be transacted at any meeting unless at least four members are present.

8. (1) No movable property of a non-perish able nature appertaining to the temple shall be transferred without the previous sanction of the Committee, and, if the value of the property is more than one thousand rupees, without the previous approval of the1 [State] Government.

(2) No immovable property appertaining to the temple shall be leased for more than three years or mortgaged, sold or otherwise alienated except with the previous sanction of the committee and the [1] [State] Government.

9. The Committee shall have no proper to borrow money from any person except with the previous sanction of the1 [State] Government.

10. Subject to the provisions of this Act or of any rules made thereunder, it shall be the duty of the Committee –

(1) to arrange for

(a) the upkeep and repair of the temple ;

(b) the improvement of the temple land ;

(c) the welfare and safety of the pilgrims ; and

(d) the proper performance of worship at the temple and pindadan (offering of pindas) on the temple land ;

(2) to prevent the descration of the temple or any part thereof or of any image therein;

(3) to make arrangements for the receipt and disposal of the offerings made in the Temple, and for the safe custody of the statements of accounts and other documents relating to the temple or the temple land and for the preservation of the property appertaining to the temple;

(4) to make arrangement for the custody, deposit and investment of funds in its hand; and

(5) to make provision for the payment of suitable emoluments to its salaried staff.

11. (1) Notwithstanding anything contained in this Act or in the rules framed thereunder, Hindus and Buddhists of every sect shall have access to the temple and the temple land for the purpose of worship or pindadan.

Provide that nothing in this Act shall entitle any person to perform animal sacrifice or to bring any alcoholic liqueur within the temple or on the temple land, or to enter the temple with shoes on.

(2) If any person contravenes the provisions of the proviso to sub-Section (1), he shall be punishable with fine not exceeding fifty rupees.

12. Notwithstanding anything contained in any enactment for the time being in force, if there be any dispute between Hindus and Buddhists regarding the manner of using the temple or the temple land, the decision of the1 [State] Government shall be final.

13. Notwithstanding anything contained in this Act or in the rules made thereunder, the Committee shall have no jurisdiction over the movable or immovable property of the Saivite Monastery of Bodh Gaya.

14. The1 [State] Government shall every year appoint on auditor to audit the accounts of the funds of the Committee and fix his remuneration which shall be paid from the said funds. The auditor shall submit hisreport to the Committee and send a copy of if to the [1] [State] Government which may issue such directions thereon, as it may deem fit, and the Committee shall carry out such directions.

15. (1) The1 [State] Government may constitute an Advisory Board (hereinafter referred to in this Act as the “Board”) which shall consist of such number of members as the [1] [State] Government may determine.

(2) The majority of the members of such Board shall be Buddhists who may not all be Indians.

(3) The members of the Board shall hold office for such term as may be fixed by the [1] [State] Government.

(4) The Board shall function purely as an Advisory body to the Committee and shall discharge its furctious in the ……… prescribed by the1 [State] Government by rules made…… behalf.

16. This Act shall have effect notwithstanding anything to the contrary contained in the Religious endowments Act2 1863, or in any decree, custom or usage.

17. (1) With the previous sanction of he3 [State] Government the commiteemay, from time, make bye-laws to carry out the purposes of this Act.

(2) In particular, and without prejudice to the generality of the foregoing powers, such byelaws may provide for :-

(a) the division of duties among the Chair-, man, the members and Secretary of the Committee;

(b) the manner in which their decision may be ascertained otherwise than at the meetings;

(c) the procedure and conduct of business at meetings of the Committee;

(d) the delegation of powers of the Committee to individual members;

(e) the book and accounts to be kept at the office of the Committee;

(f) the custody and investment of the dunds of the Committee;

(g) the time andplace of its meetings ;

(h) the manner in which notice of its meeting shall be given;

(i) the preservation of order and the conduct of proceeding at meetings and the powers which the Chairman may exercise for the purpose of enforcing its decisions;

(j) the manner in which the proceeding of its meeting shall be recorded;

(k) the persons by whom receipts may be granted for moneys paid to the Committee; and

(l) the maintenance of cordial relations between the Buddhistsand the Hindu pilgrims.

(3) All bye-laws, after they have been confirmed by the1 [State] Government, shall be published in the Official Gazette, and shall thereafter have the force of law.

18. The1 [State] Government may make rules2 to carry out the purposes of this Act.

BYE-LAWS OF THE BODH GAYA TEMPLE MANAGEMENT COMMITTEE

No. A/B1-1026/56-P.G. 435. The following bye-laws made by the Bodh Gaya Temple Management Committee under Sub-section (1) of Section 17 of the Bodh Gaya Temple Act, 1949 (Bihar Act 17 of 1949), having been confirmed by the State Government, are hereby published as required by Sub-section (3) of the said Section :-

By-laws under Section 17 of the Bodh Gaya Temple Act.

1. In these bye-laws unless the context otherwise indicates :

(i) ‘Act means the Bodh Gaya Temple Act, 1949 (Bihar Act XVIII of 1949).

(ii) ‘rules’ means rules farmed by the State Government under section 18 of the Act.

(iii) ‘Bye-laws’ means the bye-laws framed by the Committee with the previous sanction of the State Government under section 17 of the Act.

(iv) ‘Chairman’ means the Chairman of the Committee.

(v) ‘Secretary’ means the Secretary of the Committee.

2. Meetings of the Committee shall be hels at the office of the Committee or at such other place at Bodh Gaya as the Chairman or in his absence, the Secretary may decide.

3. Meetings of the Committee shall be held, as far as possible, at intervals to exceeding three months.

4. The agenda for a meeting shall be prepared by the Chairman after taking into consideration suggestions (if any) received in this behalf from the members, and resolutions received in the office of the Committee at least seven days before the notice meeting is issued to members shall be included therein.

5. Notice of a meeting together with copies of the agenda shall be circulated to members by post by Express delivery letters, or by messengers i case of local members, at least, twenty-one days before the date fixed for the meeting Providing that in case of an emergency a meeting may be called on seven days’ notice.

6. Notice of a meeting together with the agenda shall be entered in a register kept for the purpose, and the register shall be open to inspection by any member at the office of the Committee during office hours.

7. The Chairman (or, in his absence, any other member elected for the purpose by members present at the meeting) shall preside over a meeting.

8. Four members shall form the quorum at any meeting.

9. The minutes of proceedings of meetings shall be recorded by the Chairman, or, in his absence, by the member who may preside at the meeting or by such other person as may be directed by the person presiding at the meeting.

10. At a meeting other than an adjourned meeting, the minutes of the last meeting shall be read out and, if approved as having been correctly recorded or after necessary correction, if any, shall be signed by the Chairman or such other member as may be presiding at the meeting.

11. At every meeting a financial statement and a report on the work done after the last meeting of the committee (including a resume of the steps taken to implement the previous decisions of the Committee), or proposed to be undertaken in future, shall be laid.

12. No subject once finally disposed of at a meeting shall be reopened or re-considered within six months from the date of its disposal, except with the concurrence of, at least, two-thirds of the members present at a meeting.

13. The Chairman may issue special invitations to persons who are not members of the Committee to attend a meeting and the invitees may participate in the deliberations of the Committee, but they will have no right of vote.

15. An adjourned meeting, being merely continuation of the original meeting, shall not require notice of more than seven days.

16. No matter may be considered at a meeting including a meeting adjourned for want of the quorum unless it is included in the agenda circulated under bye-law 5 :

Provided that, at the request of any member or on his motion, the Chairman (or, in his absence, the member presiding at the meeting) may include any matter in the agenda if he is satisfied about its urgency.

17. Any member of the Committee may make suggestions in writing for the inclusion of any matter in the agenda of a meeting and the same shall be considered by the Chairman and, in case the Chairman does not include in the agenda any such suggestion which has been received in the office of the Committee more than seven days before the notice together with the agenda is issued to the members, he shall record the reasons for inability to include the suggestion in the agenda and inform the member concerned of it.

18. The suggestions mentioned in bye-law No. 18 shall together with the date of their receipt in the office of the Committee be entered in the order in which they are received in a register to be maintained for the purpose.

19. The Chairman, or the Secretary, in consultation with the Chairman, shall convene meetings of the Committee;

Provide that, if no meeting is held within three months, any member may send a requisition to the Chairman requesting him to call a meeting and the Chairman (or the Secretary in consultation with the Chairman) shall thereupon call a meeting of the Committee and, if the Chairman (or the Secretary) fails to call a meeting within a year, any four members may call a meeting of the Committee.

20. Within seven days of the holding of a meeting, the minutes of the proceedings of the meeting shall be circulated to all members of the Committee, and a copy thereof shall be forwarded to the State Government and the Commissioner, Patna Division by the Chairman.

21. (i) If any question of importance requiring urgent consideration arises, the Secretary, with the consent of the Chairman, or the Chairman on his own motion may ascertain the opinions of the members thereon otherwise than at a meeting by referring the matter to them in writing by registered post.

(ii) In making the reference the question on which the opinion of the members is to be ascertained shall, as far as practicable, be framed succinctly and precisely, split into parts, if necessary, so that the answer to the parts or whole may be ‘yes’ or ‘no’.

(iii) A short explanation note shall accompany the question.

(iv) The decision of the majority of the members so ascertained shall operate as the decision of the Committee and shall have the same binding force and effect as that of a decision arrived at a meeting.

(v) The majority opinion shall be calculated and determined on the basis of opinions received in the office of the Committee before the 22nd day of the despatch of the registered letters in this regard to the members :

Provided that, if the majority opinion becomes clear before the lapse of the said period of 21 days, the Secretary shall proceed to act on it forthwith.

(iv) The opinion so ascertained shall be reported in writing to the next meeting of the Committee and then incorporated in its minutes.

22. The annual budget of the Committee shall be finalised every year not later than the 31st January, and , at least, one month before the date of the meeting convened for the purpose of considering and passing the budget, the Secretary shall, in consultation with the Chairman, prepare:-

(i) an estimated budget of expenditure which may be incurred during the ensuing financial year;

(ii) a statement showing all expected receipts from all sources during the ensuing financial year;

(iii) an estimate of the balances likely to be available for expenditure during the ensuing financial year, and circulate them with an explanatory memorandum, to all members of the committee at least 21 days before the date of the meeting.

23. No expenditure shall be incurred unless it is sanctioned in the budget:

Provided that, to meet unforeseen and urgent expenditure, the Committee shall, subject to rules, be competent to sanction special grants during the year.

24. The power of the Committee to sanction special grants to meet unforeseen and urgent expenditure, may by a resolution of the Committee, be delegated to the Chairman and/or the Secretary.

25. At the meeting of the Committee convened to consider the annual budget estimates, statements and proposals, the Secretary shall place the final accounts of the financial year next preceding and the provisional accounts of the financial year.

26. The budget for a financial year passing at the meeting of the Committee referred to in the bye-law 23, shall be forwarded for information to the State Government, and to such other authority as the State Government may, from time to time, indicae,

27. All money received whether by way of donation, subscription or any other manner, shall be credited to the Fund of the Committee.

28. Charity boxes shall be opened at least a month by the Chairman or any other person authorised by him in writing, in presence of two other responsible persons who will each certify in writing what amount is taken out of each such box.

29. Accounts will be maintained in the local branch of the State Bank ofIndia.

30. All money received by or on behalf of the Committee must be deposited in the Bank within the next three working days of the bank after such receipt.

31. Payments exceeding Rs. 20.00 except the payment of salaries and emoluments of the staff of the Committee, shall be made by cheques signed by the Chairman or signed by the Secretary and countersigned by the Chairman.

32. For all money any articles received by or on behalf of the Committee the Chairman or any other person authorised in writing by him shall issue printed receipts, the counterfoils of which shall be preserved for a period of twelve years.

33. The income and the property of the Committee, howsoever derived, shall be applied solely towards the proper performance of the duties of the Committee as laid down in the Act.

34. Subject to the control of the Chairman, the Secretary shall be in charge of the funds of the committee.

35. Subject to the provisions of the Act all transfer of properties, movable or immovable, whether by way of lease, mortgage, sale or otherwise shall be openly negotiated and completed :

Provided that the Chairman, or such person as may be authorised in writing by him in this behalf, may have any perishable article auctioned after giving locally notice of the auction by beat of drum.

36. All leases and contracts shall be made in open public bids held after seven days of proper and public notice.

37. The lease shall usually be given to the highest bidder for reasons to be recorded in writing by him.

38. In giving out contracts, the lowest tender shall ordinarily be accepted:

Provided that the Chairman will have the right to give a contract to a person whose tender is not the lowest for reasons to be recorded in writing by him.

39. The Chairman may authorise the Secretary or the senior most member of the staff of the Committee to keep with himself a permanent advance of a sum not exceeding Rs.50/- for incurring expenditure on contingencies, which will be recouped by drawing regular bills after submission of proper vouchers for each item of expenditure already incurred.

41. (i) The appointment or the dismissal of member of the staff of the Committee employed on a salary of Rs. 50/- a month and above shall rest with the Committee.

(ii) The Chairman may appoint, suspend or dismiss any employee of the Committee whose salary is less than Rs. 50/- a month :

Provided that, all such appointments, suspensions and dismissals must be reported with the reasons therefore for information at the first meeting of the Committee held after the order or appointment, suspension or dismissal has been passed.

(iii) The Chairman may, pending an inquiry, suspend an employee of the committee drawing a salary of Rs. 50/- a month or more for misconduct, incompetence, neglect of duty or any other sufficient cause :

Provided that he action taken along with the explanation, if any, submitted by the employee, shall be reported to the Committee for proper action all its first meeting held after the order of suspension has been passed.

(iv) All temporary employees of the Committee, whose services may no longer by required hall be liable to be discharged after one month’s notice or on payment of one month’s salary in lieu thereof. Permanent employees may be removed from service after consideration of an explanation to be submitted by them within a reasonale time.

(v) The Chairman may impose a fine not exceeding one tenth of one month’s salary on any employee of the Committee drawing a salary not excceding Rs. 50/- a month for misconduct, neglect of duty or any other sufficient cause.

(vi) The Chairman may impose a fine not exceeding one-tenth of one month’s salary on any employees of the committee drawing a salary of Rs. 50/- a month or above but the order imposing the fine shall be submitted to the Committee for approval at its first meeting held after the order is passed and the Committee may approve, rescind, or modify the order.

(vii) The Chairman shall call upon the employee concerned to explain his conduct and consider the explanation, if any, submitted by the employee before he passes an order imposing a fine.

(viii) All persons employed by a Committee shall, if required, furnish such security as the Committee may from time to time determine.

(ix) During the period of suspension pending enquiry into his conduct, an employee will get as subsistence allowance only one-half of the salary which he was entitled to draw on the day he was suspended.

42. The General superintendence and control of the establishments maintained by the Committee shall vest in and be exercised by the Chairman. The Chairman shall be in general control of the funds of the Committee and shall enter into contracts or execute leases or other documents and pass bills for payments, on behalf of the committee.

43. The Secretary shall be the Chief Executive Officer of the Committee, and shall excericse supervision over the staff of the committee and keep the books of accounts and other principal records of the Committee.

44. The Committee may designate the seniormost member of its office staff as its Superintendent who shall :-

(i) have the general charge of the office of the Committee and its day to day work

(ii) subject to any general or special direction which the Chairman or Secretary may from time to time give, deal with routine correspondence.

(iii) examine and sign the cash-books and keep them in order and up-to-date;

(iv) he responsible for the maintenance of the purity and cleanliness of theTempleand theTempleland; and.

(v) look after the comforts of visitors and devotees.

45. All communication received in the office marked ‘Secret’, ‘Confidential’, or ‘Personal’, (or addressed by name) shall be opened by the Chairman or the Secretary (according as who is the addressee).

46. The common seal of the Committee shall remain in the custody of the Chairman, or, if he so directs in writing, of the Secretary.

47. The common seal shall be affixed to the following documents :-

(i) all deeds of transfer executed by, or, on behalf of the Committee;

(ii) all written contracts entered into by the Committee;

(iii) the minutes of proceedings of the Committee;

(iv) notices of the meetings of the Committee;

(v) all receipts for money grated on behalf of the Committee; and

(vi) any other documents which in the opinion of the Chairman or the Secretary, is of importance

48. (i) For the proper maintenance of accounts and efficient discharge of its duties the Committee shall maintain necessary books and registers in its office.

(ii) A list of such books and registers shall be maintained in the office

(iii) Books and registers maintained by the Committee shall be open to inspection, during office hours, by the members of the committee and with the permission of the Chairman or the Secretary, by any other person.

49. The Committee may from time to time, for any purpose connected with its work, appoint sub-committees consisting of such of its members and any others persons as it may think proper and such sub-committees shall exercise such powers and perform such functions as may be prescribed by the Committee.

50. Any addition, alteration or modification in these bye-laws may be made by the Committee by a majority of votes of the members of the Committee, subject to confirmation by the State Government and publication in the official Gazette.

51. In matters no specifically provided for in these by-laws the Committee shall be competent to pass orders and regulate its affairs in such manner as in necessary for the discharge of its duties in accordance with the Act and the rules.

52. The Committee may, by a resolution, delegate such of its powers to the Chairman or the Secretary as it may consider necessary.

53. The Secretary shall prepare each year a report of the affairs and activities of the committee and present it at its meeting held to consider and pass the budget. A copy of the report shall be forwarded to the State Government along with the budget estimates.

54. The members of the Committee including the Chairman and the Secretary and the special invitees to the meetings of the Committee and Sub-committees shall be entitled to travelling allowance and daily allowance for attending the meetings of the Committee and its Sub-committees (and for other journeys required in connection with the work of the Committee, in the case of the Chairman and Secretary) at the following rates :

(i) Single second class railway fare from the railway station nearest the members or special invitees, place or residence to the railway stations nearest the place of the meeting.

(ii) Eight annas for each mile of distance travelled by road in the course of journey from the place of residence to the place of meeting.

(iii) Daily allowance at the rate of Rs. 5/- per diem for the duration of the meeting and an allowance of Rs. 5/- as out of pocket expenses for every day spent in travelling between their places of residence and the place of the meeting and vice versa :

Provided that, the out-of-pocket expenses shall not be paid for the day or days for which daily allowance is admissible.

Provided further that, that employees of the State Government shall not be entitled to charge any travelling allowance or daily allowance or out-of-poket expense from the funds of the Committee.

55. The staff of the Committee shall be entitled to such rates of travelling and daily allowances as the Chairman may, from time to time, after due consideration of the finances of the Committee, by an order in writing determine and such rates shall until modified.

It is a great shame for Bihar thatMahabodhiTempleis not a National Monument. Last 3 years I am taking up that issue with BTMC even by RTI but your great BTMC not answering it. Look at the file dear madam jee. What a joke of the century that a World Heritage Site isnotNational Monument( Mera Desh Mahan ). It is possible only isBihar. The cause behind is political which is to give accommodation to 3 political members who have no base in the public life but working of the party for long time and for that reason they have to accommodate in some places and BTMC is the right place for such baseless party workers. What a joke dear madam jee when a member’s duty is only to come at the time of meeting and they have no power what so ever as per 1949 BTMC act. To-days political members are acting such a manner that they are in some high position.

TheBodhgayaTempleis the place of corruption since last 60 years except few years when Gayan Jagat gee was here and the great honest man from district administration was secretary of BTMC. You can see his photo at BTMC office. These corrupt members will never allowed the temple to be national monument because if they do then these members have no place to sit and earn under table the way your great kalicharan Singh Yadav and Arbind Singh is playing now in the temple. Look at the report of State intelligence, Central Intelligence report, SI Jamil Akhtar report about the Organizing Puja at 2008. Dear Madan Jee if you have a drop of honesty in your life book then investigate about it or called up DM Sanjoy Singh.

General Suthum loves Buddha and he is behind all donations to BTMC to serve the people but you are all cheating this good innocent man. Think for a moment that even after cheating he is coming to you every time !!! Just imagine Bhante Bodhi Pal Cheated 30, 000 dollars, then again he cheated when the back side public toilet construction was going on and again 2012 he is being cheated. Just think for a moment Chairman Shahiba Ji how with out tender some one can construct any thing when the area is control by public property authority ?? Under which law of constitution you did it when you are in public property ?? Do you and your members thinks that this is your personall property ?? How DCA can work in your area without your permission ?? Without tender how you can allowed DCA to work ?? How you allowed your member Arbind Singh to construct the toilet ?? When you saw all the materials then how many times you issued letters to DCA ?? Mr. Lertruth is just a helping man of General Suthum and he can’t work in Indian with out the permission of any Indian authority same way DCA too. This Mr. Lertruth is dishearten by the acts of Indian.

What is the condition of Stupas ?? What is the condition of Holy Bodhi Tree ?? How you disobey the expert committee report and the scientist report ?? Even you gave affidavit in the court that railing has been taken out then how still the railing is there ?? Read tour report 5-6 May 2008. Read the affidavit of F.R.I in the hon’ble patnahigh court and then you see what was the condition at the time of yearly puja by different organization from Oct. to March. Look at the media report about it. I know I am talking to a deaf and dump but as a monk my duty is to knock your door every time like the way we eat daily food.

Look at the photos of beggars and tell me why BTMC allowed such “ DANA” ?? Look at the Korean Btv man how he is shooting !! If it is Dana then why photography ?? They show our things there and then these types of monks like our Bodhgaya NGO’s gather huge money in the name of poor people. Look carefully how media persons are also present and taking photos. What the social security dept ofgayais doing ?? When the law is there then why your officer is sitting ingaya?? What the police dept is doing ?? It is not one day matter but every year it is happening and all your officers are sleeping. Can I expect from you that now you will weak up from your Deaf and Dump condition ??

If you say no then the question is why not there is any action regarding the goal ghar market place toilet corruption ?? After all it is a matter of 60 lakhs rupees as per General Suthum wife from thai land. And you also don’t worry being a daughter of “ Dhitorast ”  because heregaya media, social worker, officers all are in same line.

My simple question is how much money you got from under the table by Arbind Singh who is your member in the Temple Management Committee. There is no tender when the area is control by you !!! Over all you are the soul authority of the gayadistrict and no law in the constitution can stop you to probe the scam. Don’t you have any civil engineer in Govt. Office to estimate the cost of the goal ghar toilet making ?? Or you can not read letters because you are a daughter of “ Dhitorast ” ?? Then the question is how you became district magistrate if you are a daughter of “ Dhitorast ” ?? If an area is controlled by the Govt. or by any Committee which is appointed by the Govt. then they have to follow the law of constitution and as per constitution you have to make tender if any works carried out by the authority. So where is tender ?? Who is looking the work on be half of bodhgaya temple management committee at goal ghar toilet making ?? More over you are not replying my letters as a chairman of BTMC as well as district magistrate.

Therefore it is proved that you are a “ THIEF ” and I am telling it writing. If you are an IAS then keep in mind I am an IIT both starts with “ I ”. If I go to court then some IAS will give report to court that “ DM of Gaya is merely a chairman with out doing day to day work …. ” when DM is the soul authority of Bodhgaya Temple Management Committee as per 1949 act. DM shahiba  Ghandhi Ji ko mar ke aap jaisa ghotala baz log desh ko bech dala. Look at the changes in theMahabodhiTempleat Bodhgaya. The minority commission ofIndiareceiving complains with evidence from Bhante Satyanand Agarwal and Arup Bramhachari ( Swami Ji ) regarding corruption in the Buddhist world at Bodhgaya. Arup Bramhachari repeating his complains again and again with the Archeological Survey of India. Now the question is what must be the next step ?? Both the national organization is not doing any thing till now regarding the issue. FIR filed but DIG of Magadh Division is silent !!  What Mr. N. Dorje is doing with you ?? Managing the corruption issue with you ?? Even the IAS’s are so coward that they have no guts to answer under RTI because Buddho Purnima is coming and if the maharastrian buddhist see all the corruption of Mahabodhi Temple then they will tear the BTMC. Hotel bills of 3 Hindu members are around 13 lakhs !!! Even they played a game with Bhante Satyanand when he asked questions under RTI. Even I am repeatedly writing to Magadh Commissioner, DIG Magadh Division who are the members of the advisory committee ofMahabodhiTempleat Bodhgaya about corruption but all are silent !!! Chief Secretary ofBihar, Home Secretary of Bihar, Tourism minister and secretary also received complains but the result is ZERO ?? So get ready to answer at Sup. Court.

Subject : What is the reason for not taking any action against BTMC corruption ??

Dear respected sir,

  1. Many times I wrote to you regarding the latest corruption of Mahabodhi Temple management corruption about making new toilet at Goal Ghar Market area ( Mahabodhi Temple Complex Market / beside multimedia centre ). Being a member of the advisory committee ofMahabodhiTempleit is your moral duty to stop corruption inMahabodhiTemple.
  2. TheMahabodhiTemplemade a new toilet at Goal Ghar area ( Beside Multimedia Centre ) by a donor fromThailandMadam  Khoon Ratan Milinat. Who paid 60 lakhs rupees to DCA ofdelhi. Madam Milinut was not satisfied the material used in the toilet infront of media on dated 26-02-2012 at Bodhgaya.
  3. The works supervised by the BTMC member Arbind Singh with DCA. Not only that the toilet plan did not approved by the Nagar Panchayat. Arbind Singh over ruled all norms by showing his power as politician.
  4. Therefore an investigation must be carried out regarding this issue. Top to Bottom all concerning officers and members are involved in this regard. The district magistrate can not over look in this issue because she is the chairman of the committee and she and secretary of BTMC is not replying my letters.
  5. Another corruption took place in the BTMC. How BTMC gave permission to a foreign organization “ The light of Buddhadhamma Foundation ” from Berkley, USA ( Madam Dixy and party ) to collect money from devotees around the world for repair work atHoliMahabodhiTemple. BTMC is not giving any data in this regard that how much money The light of Buddhadhamma Foundation fromBerkley,USA collected when it is a public property. From top to bottom of BTMC got enough under table that is the reason why they did not put FIR against BuddhaDhamma Foundation if they did not gave any short of permission. Not only that The Buddhadhamma Foundation not even gave any data of donation till 10-04-2012 at their web site. The district magistrate knows every aspect of it as a chairman but she is silent because she got under table.
  6. It is your examination as an honest officer as well as citizen ofIndiathat how much you are an honest man. As I know that for an IPS very difficult to file a case of cheating against an IAS.

Subject:- Prayer for institution of F.I.R. against the culprits named below:-

3. Arbind Kumar Singh, Member of Bodhgaya Temple Management Committee

5. Radhakrishna Mishra, Member of Bodhgaya Temple Management Committee

Sir,

With due respect I crave to urge as follows:-

That, the culprits are entrusted with dominion over many properties of theHolyMahabodhiTempleat Bodh Gaya in their capacity either as a public servants or attorneys or agents.

That, it has come to the knowledge of mine and many other persons that the above culprits have dishonestly misappropriated and converted to their own use the properties, so entrusted to them, in utter violation of the direction of the law prescribing the mode in which the said trust is to be discharged.

That, the culprits have forged various documents purporting to be receipts acknowledging the payments of money or receipts for getting delivery of any movable property and thereby the culprits have incessantly been embezzling the cash, movables assets and other properties of the temple for their own use.

That, the culprits, with intent to cause damage or injury to the assets of the Bodh Gaya Temple, have fraudulently and dishonestly cancelled, destroyed, defaced and secreted all the relevant documents that could have shown commission of crimes by the above culprits.

That, in every work, shown to be done in the Bodh Gaya Temple, the above factum of commission of crimes by the culprits can very easily be found out such as construction of toilet at Mahabodhi Shopping Complex with the help of DCA, Cobra Security agency deployment, giving illegal permission to The light of Buddhadhamma Foundation International, Berkley, USA to collect money from all over the world for renovations work at Mahabodhi Temple, so on and so forth. In the year 2007 Dr. K.P Ramaiya commissioner of Magadh Division wrote in his report to Gaya CJM court that a high powered committee must investigate theMahabodhiTemplefinancial corruption and his member’s property.

That, hence, the culprits have committed crimes punishable under Sections 406, 409, 467, 477 and 120B of the Indian Penal Code.

I pray to lodge an FIR against the culprits and to investigate the matter to surface the truth.

( Hereinafter referred to as “ the address No. 1, 2, 3 and 4 respectively, duly executed by me, named above, I am serving the instant legal notice under aforementioned provisions of law upon you )

Follows :-

1.   That, under the mandatory provisions of theBodhgayaTempleact, 1949 the address No.2 has been entrusted with the management and control of theMahabodhiTemple, The Bodhgaya Temple land and properties appertaining thereto.

2.   That, vide section 5 of theBodhgayaTempleact, 1949, the address No. 1 is empowered to dissolve the address No.2 and to constitute another committee, if the address No. 1 is satisfied that the address No. 2 is guilty of gross mismanagement.

3.   That, paramount to mention that the address No. 2 is guilty of gross mismanagement owing to the reason, depicted infra :-

Reason No. A :- 

The Bodhgaya Temple Management Committee and The Forest Research Institute, Dehradun jointly said in the Hon’ble Patna High Court with an affidavit that they have already taken out the Metallic Grill and marbles from under the Holy Bodhi Tree which was a white lie and still the Metallic Grill ( In the Golden colour ) and the marbles standing at there place. It is required to be done so that fresh air could reach the Mahabodhi Pipal Tree.

Reason No. B :-

The Bodhgaya Temple Management Committee changed the original shape of the umbrella of the temple at top by the help of the so called working for the protection of Lord Buddha’s Faith which is known as The Light of Buddhadhamma Foundation International,Berkley,USA.

Reason No. C :-

The Bodhgaya Temple Management Committee gave permission to The Light of Buddhadhamma Foundation Intenational to collect money from the devotees for the repair works atMahabodhiTempleat Bodhgaya. How much money this foundation collected that no one knows and under RTI dated 13-02-2012 BTMC wrote that they did not gave any permission to any one to collect money in the name ofMahabodhiTemplerepair works. And when the fax copy dated 09-10-2012 released by Richard Dixey shown to BTMC secretary Mr. N. Dorje then he was speechless for telling lies.

Reason No. D :-

The Bodhgaya Temple Management Committee also changed the out look of the Lord Bhuddha idols inside theMahabodhiTemplewhere all the devotees offer prayers. The change made by a Thai donor whose name is Mrs. Malinote and who brought the Thai craftsman to do the fabrication work. When at 2009 same project brought into notice by the then DM Mr. Sanjoy Singh to the expert committee and then they placed a condition infront of the organization that all the works must be carried out by the Archaeological Survey of India without changing the basic fabric. How the works carried out without the experts of Archaeological Survey of India and how the management can change the out look of the inside of a heritage ?

Reason No. E :-

The Bodhgaya Temple Management Committee made a new toilet just beside Multimedia Centre ( Mahabodhi shopping complex ) which is donated by Mrs. Malinote fromThailand. This toilet cost 60 lakhs rupees to Mrs. Malinote and she was unhappy after watching to quality of the material used at the time of making the toilet. This toilet does not have any permission from Nagar Panchayat of Bodhgaya. Member Mr. Arbind Singh made this toilet by the help of DCA Company fromDelhi. Even after receiving complains District Magistrate, Commissioner of Magadha did not take any action.

Reason No. F :-

The Bodhgaya Temple Management Committee does not take care of the donation box for which worth of 14 lakhs rupees dilute in the donation box for going water in the donation box.

Reason No. G :-

Number of pervious idols are missing from the Mahabodhi Temple and the idols are being stolen by the culprits and nay this fact is fully known to the address No. 2 but nothing has been done either against the culprits or to recover the missing idols or to pin point the guilty.

Reason No. H :-

By the report of the Dehradun based Forest Research Institute it is apparent that Mahabodhi Pipal tree was mercilessly cut. But, alas !! no action against the culprits was ever tried to be taken by the address No. 1, 2 and 4. And what was the report said in the year 2006 when the 1st time bodhi tree cut off issue broke out in the media. Scientist from Ragendra Krishi Vishwavidalay took the samples from the cut off portion for testing ans where is that report.

Reason No. I :-

The address No. 1, 2 and 3 did neither strive to find out as to where the controversial cut off portion of the Mahabodhi Pipal Tree was / is nor ever try to bring back the same nor cause to probe into the matter incidental thereto.

Reason No. J :-

The Ex-officio Secretary of Bodhgaya Temple Management Advisory Board, i.e. The Commissioner of Magadh Division, did recommended fore high level inquiry / investigation team for discovering the culprits for above crimes ( misuse of temple fund and cut off portion ). But the address No. 1, 2 and 4 never acted upon the above recommendation.

Reason No. K :-

The ornaments which was missing in the year 2007 and then found from the room of ex- chief priest Bhante Bodhipal and the temple management committee have been deposited to the government treasury without verifying the same by the experts so that geniuses there of could first be ascertained.

Reason No. L :-

Few members of the address No. 2 are used to utilize the temple fund of the addressee No. 2 in paying bills of various hotels used for their personal needs and to use the vehicles of the addressee No. 2 for their personal needs and deeds.

Reason No. M :-

Neither use of loudspeakers has been banned, nor the controlling of devotees took place which was the advise of the expert committee, no action has been taken place to stop the soil compaction under the mahabodhi pipal tree, no action has been taken to stop hanging cloths around the bodhi tree, no action has been taken to stop the shows going inside of the temple, no action has been taken to stop the high powered lights at night which is harming the tree.

Reason No. N :-

No steps have ever been taken in true sense by the addressee No. 2 to save and preserve theBodhgayaTempleand the Mahabodhi Pipal Tree.

4.   That, the above listed factual matrix  are merely glimpses of gross mismanagement caused by the address No. 2. The actual list is many times more than portrayed supra.

5.   That, is the reason why I am sending you instant legal notice pro bono publico i.e in the general interest of the country and the citizens at large.

6.   That, under aforesaid circumstances, the people of great India speaking through me has valuable rights to seek from the address No. 1 to dissolve the address No. 2 for the sake of saving the prestige of India.

7.   That, the cause of action for this legal notice stemmed forth several times but lastly on 16.04.2009 when the prayer of the public through me redress of aforementioned grievances made to the addressee No.2 through chairman was badly refused at Bodhgaya Temple P.S & Post. Bodhgaya,Gayawithin the jurisdiction ofGaya Civil Courtand Hon’ble Patna High Court.

8.   That, I am entitled to the relief, depicted infra :-

A.   The addressee No.2 be dissolved forth with and a new committee be constituted for apt, befilling and consummate management of Bodhgaya,Temple, theBodhgayaTempleland and properties appertaining thereto.

B.   Any other quitable relief.

C.   Cost of the entire legal proceeding.

9.   That, the instant legal notice the great Indian Citizen Speaking through me provides an opportunity to the addressees for redressal of the grievances by granting relief’s, elucidated earlier, within statutory priod failing which I will have no other option but for to take the matter before the Supreme Court.

10.  That the instant legal notice has been prepared in 6 copies out of which one one copy is being sent to all addressees separately and the 5th and 6th copy is being preserved with me for future use.
